These Terms & Conditions apply to all offers, orders and agreements concluded via the website of Filogina.

Filogina is a sole proprietorship (eenmanszaak) established in the Netherlands.

Applicability
These Terms & Conditions apply to every offer and distance contract concluded between Filogina and a consumer.
Before completing an order, the customer must explicitly accept these Terms & Conditions.
If any provision is found to be invalid, the remaining provisions remain fully effective.

Products and Services
Filogina offers:

  • Physical lingerie and related products via Shopify
  • Digital content and online masterclasses via LearnWorlds

All product descriptions are presented as accurately as possible. Minor variations in color, materials, or appearance do not constitute a defect.

Ordering Process
An agreement is concluded once the customer completes the checkout process and receives an order confirmation email.
Filogina reserves the right to refuse or cancel orders in case of:
• Incorrect pricing
• Suspected fraud
• Payment failure
• Obvious errors

The contract language is Dutch and/or English, depending on the version selected.

Prices and Payment
All prices are stated in EUR and include VAT, unless explicitly stated otherwise.
Shipping costs are displayed before finalizing the order.
Payment must be completed using the payment methods offered on the website. Orders will only be processed after successful payment.
In case of non-payment, Filogina reserves the right to suspend delivery and claim statutory collection costs where applicable.

Delivery
All Filogina products are made to order. Production time is approximately 5–7 business days.
Once completed, orders are shipped. Delivery within the Netherlands generally takes 1–3 business days after dispatch.
In accordance with Dutch consumer law, delivery will in any event take place no later than 30 days after order confirmation, unless a different period has been expressly agreed.

Right of Withdrawal (Physical Products)
Consumers have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period expires 14 days after the day on which the consumer (or a designated third party, other than the carrier) receives the product.
To exercise the right of withdrawal, the consumer must notify Filogina via:

The consumer may use the model withdrawal form, but this is not mandatory.
The consumer must return the goods within 14 days after notifying withdrawal.
Return shipping costs are the responsibility of the consumer.
Refunds will be issued within 14 days after receiving the returned goods or proof of shipment.
Filogina may deduct compensation for diminished value if the product has been used beyond what is necessary to assess its nature and functionality.
The following items are excluded from the right of withdrawal:
• Products sealed for hygiene reasons once opened
• Customized or made-to-order items
• Perishable goods

Exclusions from the Right of Withdrawal
The right of withdrawal does not apply to:

  • Products sealed for hygiene reasons once unsealed after delivery
  • Personalized or custom-made products made according to consumer specifications
  • Digital content once performance has begun with prior consent

Digital Products & Masterclasses (LearnWorlds)
Digital content and online masterclasses are delivered via LearnWorlds.

By purchasing digital content, the consumer explicitly agrees that:
1. Delivery begins immediately after purchase.
2. The right of withdrawal expires once access to the digital content has been granted.
3. The consumer acknowledges and consents to the loss of the right of withdrawal for digital content.
Access credentials are personal and may not be shared.
Filogina reserves the right to suspend access in case of misuse.

Legal Warranty (Conformity)
Filogina guarantees that products comply with the agreement and meet reasonable expectations of usability and quality.
Under Dutch law, consumers are entitled to a product that conforms to the contract.
If a product is defective or does not conform, the consumer is entitled to:
• Repair, or
• Replacement, or
• Refund (if repair or replacement is not possible or disproportionate)
This statutory warranty exists independently of any commercial guarantee.

Intellectual Property
All intellectual property rights relating to:

  • Designs
  • Patterns
  • Branding
  • Website content
  • hotography
  • Masterclasses
  • Educational materials

remain the exclusive property of Filogina.
No content may be copied, distributed, reproduced or used commercially without prior written consent.

Liability
Filogina’s liability is limited to the extent permitted by law.
Filogina is not liable for indirect damages except in cases of:

  • Intent or gross negligence
  • Death or personal injury
  • Breach of essential contractual obligations

Nothing in these Terms excludes mandatory consumer rights.

Retention of Title
All goods remain the property of Filogina until full payment has been received.

Force Majeure
Filogina is not liable for delays or failure to perform obligations due to circumstances beyond its reasonable control, including but not limited to:

  • Supply chain disruption
  • Material shortages
  • Transport interruptions
  • Government measures
  • Technical failures

In such cases, obligations are suspended for the duration of the force majeure situation.

Complaints
Complaints must be submitted within a reasonable time after discovering the issue.

Filogina will respond within 14 days. If more time is required, the consumer will be informed accordingly.

Online Dispute Resolution (ODR)
The European Commission provides a platform for online dispute resolution:

Consumers are not obligated to use this platform but may do so.

Privacy
Personal data is processed in accordance with Filogina’s Privacy Policy, available on the website.

Governing Law
These Terms & Conditions are governed by Dutch law.
Consumers residing within the European Union retain the protection of mandatory consumer laws applicable in their country of residence.
